Since 3rd December 2010 there is a new incentive for limited liability companies (llc) and public limited companies (plc). These corporations don´t have to pay the 1% property acquisition tax in the following cases:
-
Foundation of the company, increase of capital,
-
Additional contribution of the shareholders,
-
Shift of the registered office from a country outside the European Union to Spain.
Therefore this change in the tax law is especially interesting for the foundation of companies, capital increases and in case of the change of the registered office.
An important application are credits hold by the company.
If you don´t think that they are refunded soon, you can change them to share capital.
Three advantages are connected with such a change:
-
The image of the company is improved,
-
The 1% property acquisition tax is saved,
-
Complications due to the taxation of the interests paid for the credits are avoided.
This tax incentive is not limited temporarily and is applicable for all sizes of companies, not only small ones.
